Retatrutide: legal status in Europe, country by country (2026)

Retatrutide (LY3437943) is an investigational drug from Eli Lilly, a triple agonist of the GLP-1, GIP, and glucagon receptors. Its legal status is the same in all European Union countries: it is not an authorized medicine. This page provides a country-by-country overview of the relevant legislation, the competent authorities, and their publications. Each statement is sourced and dated.

The key points, as of October 15, 2026

  • No marketing authorization (MA)for retatrutide, neither in the European Union (EMA), nor in any Member State, nor in the United States (FDA) or the United Kingdom (MHRA).
  • The molecule isin phase 3 of clinical trialsEli Lilly has published positive results in 2026 and plans to submit its application to the FDA by the first quarter of 2027. No submission to the EMA has been announced.
  • Across the EU, a productpresented or used as a drugcannot be sold without marketing authorization (directive 2001/83/EC, transposed into each country).
  • In France, the ANSM published an alert on July 2, 2026 against "peptides" sold online, which cites retatrutide, and has taken several withdrawal decisions.
  • Outside of authorized clinical trials,There is no legal framework allowing the use of retatrutide in humans..

What is the status of the authorization for retatrutide?

Retatrutide is being developed by Eli Lilly. Following the phase 2 trial published in the New England Journal of Medicine in 2023, the phase 3 TRIUMPH program yielded its first results in 2026.

  • May 21, 2026: main results of TRIUMPH-1 (obesity), announced by Lilly.
  • July 23, 2026: results of TRIUMPH-2 and TRIUMPH-3. Lilly announces it expects to file with the FDA by the first quarter of 2027.
  • October 15, 2026: no European marketing authorization, no application announced as having been submitted to the EMA.

The centralized European procedure generally takes more than a year between submission and the Commission's decision. Authorization in the EU is therefore not expected before 2028 at the earliest (estimate, no official date).

What European law says

The framework is common to all 27 member states:

  • Definition of a medicinal product (Directive 2001/83/EC, Article 1): A medicinal product is any substance presented as having properties to treat or prevent diseases in humans, or used to restore, correct, or modify physiological functions. A product sold for weight loss falls under this definition, regardless of its labeling.
  • Marketing Authorization Obligation(Article 6): No medicinal product may be placed on the market without European (EMA) or national authorization.
  • Distance selling(Article 85 quater, from Directive 2011/62/EU): the online sale of medicines is reserved for authorized persons, identified by a common European logo.

A chemical substance sold asresearch reagentA product, without any presentation or use as a medicine, is not covered by a specific European text. However, as soon as a product is presented, recommended, or used for human use, it falls under the legislation governing medicines, and the statement "for research use only" does not protect it (see the ANSM's position below).

The position of the ANSM in France

On July 2, 2026, the ANSM (French National Agency for Medicines and Health Products Safety) published the alert “Peptides sold online: do not use them, they can be dangerous.” The agency stated that it had received several reports of the use of fraudulent peptides, including retatrutide, some of which led to hospitalizations. It advised against using products labeled “For research use only,” “Reserved for research,” or “Not for human use.”

The agency has taken public health decisions against sellers of injectable pens presented as GLP-1 agonists: on July 9, 2026 (Synedica Laboratories), on July 16, 2026 (Azentra, AZRL Ltd) and on August 14, 2026 (product “FastPen 40 mg” presented as containing retatrutide).

Outside the European Union

  • United States (FDA): warning letters to online sellers, including one dated March 31, 2026 which describes their retatrutide as a "new, unapproved drug" despite the mention "research use only".
  • New Zealand (Medsafe): consumer advisory of May 21, 2026 on unapproved “peptides”, which cites retatrutide.
  • Australia (State of Victoria): health alert of June 19, 2026, six cases of acute liver injury in people who used a product labeled retatrutide.

Specifically

For an individual

Retatrutide is not available in pharmacies or by prescription. The only legal way to access it is to participate in an authorized clinical trial. Trials conducted in Europe are listed in the EU's public registry (CTIS, euclinicaltrials.eu) and on ClinicalTrials.gov.

For a laboratory

Retatrutide can be acquired asresearch reagentfor in vitro studies, without any human or veterinary use. The laboratory must be able to document the product (batch analysis certificate, batch number, storage conditions).

MyPeptide's position

MyPeptide sells retatrutide exclusively as a research reagent to researchers and scientific institutions. Each batch is analyzed by an independent laboratory, and the report is published on the page.Certificates of analysisTo verify a report yourself:How to verify a Janoshik certificate.

Frequently Asked Questions

Is retatrutide legal in France?

Retatrutide is not authorized for sale in France: it cannot be sold or used as a medicine. On July 2, 2026, the ANSM (French National Agency for Medicines and Health Products Safety) issued a warning about peptides sold online, which specifically mentioned retatrutide, and ordered the withdrawal of several products. Only its sale as a research reagent, without presentation or use as a medicine, is not specifically addressed by this regulation.

Is retatrutide authorized by the EMA?

No. As of October 15, 2026, retatrutide has no European authorization and no application has been announced as having been filed with the EMA. Eli Lilly plans to file with the US FDA by the first quarter of 2027.

When will retatrutide be authorized in Europe?

There is no official date. The European procedure generally takes more than a year after the application is submitted, which has not yet been announced: authorization is not expected before 2028 at the earliest.

Can retatrutide be used on oneself?

No. Outside of authorized clinical trials, there is no legal framework permitting the human use of retatrutide in the European Union. The ANSM (French National Agency for Medicines and Health Products Safety) has reported serious side effects and hospitalizations following the use of products sold online.

Does the phrase "for research use only" make a product legal?

No, if the product is presented or used for human use: it then falls under the legislation governing medicines. The ANSM (French National Agency for Medicines and Health Products Safety) explicitly advises against using products bearing this label, and the FDA has classified products sold with this designation as unapproved medicines.

Is retatrutide legal in Germany, Italy, Spain, or Portugal?

The status is the same in all EU countries: no marketing authorization, therefore neither sale nor use as a medicine. The competent authorities are the BfArM in Germany, AIFA in Italy, AEMPS in Spain, and INFARMED in Portugal.
